Amazon is facing lawsuits in the United States from families who allege negligence after a potentially dangerous chemical was sold through its platform. The case has reached the Washington State Supreme Court, which has now allowed the claims to proceed. In a unanimous decision, the state’s highest court ruled that the lawsuits against the company are legally admissible. In doing so, it overturned a lower court ruling that had previously cleared Amazon of liability.

At the center of the case is the concept of “duty of care.” According to the court’s reasoning, the company may have a legal obligation to take reasonable steps to prevent foreseeable harm linked to products sold on its marketplace. A total of 28 families claim that Amazon had been aware for years of the risks associated with the sale of high-purity sodium nitrite but allowed third-party sellers to continue offering the chemical without sufficient restrictions.

The plaintiffs argue that the company did not establish effective mechanisms to limit potentially harmful purchases. Their attorneys contend that a corporation of Amazon’s size and resources carries a proportionate responsibility. Amazon has historically maintained that it serves as an intermediary in many third-party transactions, complicating the legal boundaries of liability in marketplace sales. The case could set an important precedent for e-commerce in the United States.

The broader question of how far online platforms should be held accountable for products sold by independent vendors remains a growing legal debate. Beyond the courtroom, the proceedings have reignited discussions about regulating the online sale of high-purity chemicals and balancing commercial freedom with consumer protection.
